    You do not acquire ownership rights to any content, document, or other materials viewed or accessed through the DISYS web-site, products, or services. You will abide by any and all additional copyright notices, information, or restrictions contained in any agreement or associated with any DISYS product or services. Any copying, republication, or redistribution of DISYS’ web-site content, or product or service information or specification, including by caching, framing, or similar means, is expressly prohibited without the prior written consent of DISYS and/or the respective intellectual property rights holder identified in the subject content.

    CONSENT TO MONITORING AND DISCLOSURE

    DISYS is under no obligation to monitor and does not regularly monitor the content and any other information residing on or transmitted to or through its web-site, products, or services by third parties. However, anyone using the DISYS web-site, products, or services agrees that DISYS may monitor the contents of transmissions periodically to (1) comply with any necessary laws, regulations or other governmental requests; or (2) to operate the web-site, products, and services properly or to protect itself and its users.     We welcome your comments about our web-site, products, or services. The comments or ideas that you may submit shall in no way prevent the purchase, manufacture or use of similar products, services, plans and ideas by DISYS for any purpose whatever. DISYS makes no assurances that your comments or ideas will be treated as confidential or proprietary.     PRIVACY POLICY

    General

    DISYS is committed to protecting your personal privacy. In order to enhance your web, product, and service experience, essential information may be recorded. For the purpose of administration and security, information may be automatically collected and stored by DISYS. DISYS staff will use and share aggregate information only. DISYS does not regularly collect or evaluate this information for individual IP addresses, nor does DISYS make any attempt to correlate the IP information with a particular client or individual. Notwithstanding the foregoing, DISYS will provide such information as necessary to authorized individuals and entities to comply with any laws or court orders, or to protect the integrity of its network. The types of information recorded include, but are not limited to the following:

    Browser Data

    Every computer connected to the Internet is given a unique set of numbers that serve as that computer’s “Internet Protocol” address. When you request any page, this address is used to “route” the information back to your machine.

    Along with the request, your web browser automatically sends a stream of information regarding the requesting machine’s capabilities. These include the browser type, version, operating system, monitor resolution, and referring page, to name a few.

DISYS DISCLAIMS ALL WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS, EXPRESS OR IMPLIED, WITH REGARD TO THE DISYS WEBSITE, PRODUCTS, AND SERVICES, AND THE CONTENT, INCLUDING BUT NOT LIMITED TO THE DOCUMENTATION AND RELATED GRAPHICS, ACCESSED FROM, OR VIA, THE DISYS WEBSITE OR THE INTERNET, INCLUDING, BUT NOT LIMITED TO, ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.     DIGITAL MILLENNIUM COPYRIGHT ACT

    • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
    • Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;

    You shall defend or settle at your sole expense any claim or suit, including without limitation any proceeding, investigation or claim by an individual, company, self-regulating organization, local, state or federal agency or commission, (collectively, an “Action”) against DISYS and its directors, officers, agents, employees, successors or assigns (collectively, the “Indemnities”) to the fullest extent permitted by law arising out of or in connection with the use of the DISYS web-site, products, or services, including but not limited to (1) an assertion that the information, content or other materials or services provided or made available by you or the use thereof may infringe any copyright or trademark rights of any individual or entity, or are a misappropriation of any individual or entity’s trade secret, or contain any libelous, defamatory, disparaging, pornographic, or obscene materials; (2) any claims that information, content, or other materials or services accessed from or posted to the web site constitutes medical, legal, financial, psychiatric, or any other advice provided to you or a third party to whom such advice is relayed, directly or indirectly, by you and that such advice created an affirmative duty, obligation, or standard of care on the part of Indemnities; (3) any breach by you of your obligations under the terms and conditions hereunder or any written agreement with DISYS; and (4) any content or information provided or transmitted by you on or through the DISYS web-site, products, or services. You shall indemnify and hold harmless the Indemnities from and against any and all damages, costs, liabilities and attorneys’ fees incurred in defending and/or resolving such Action.

    NON-CONTRAVENTION

    To the extent that there is a written agreement in full force and effect between you and DISYS, the terms of the written agreement shall control the relationship of the parties; provided, however, that the terms and conditions herein shall apply to the extent that they do not contradict the terms of the parties’ agreement.

    GOVERNING LAW

    Except for intellectual property matters governed by the federal laws of the United States, the foregoing provisions shall be governed by and construed in accordance with the substantive laws of the State of Virginia, without regard to the principles of conflict of law thereof.
